ok, I know I've read posts on this before, but what do you do when someone has blatenly stolen your auction?

Do you suggest I write the seller, or write ebay? I am really pizzed off. I feel like bidding thru the roof and npb'ing it.

This person has the nerve to steal my picture but its so obvious because I was anxious to list it real fast and didnt notice there was a semi-coffee stain on the table (lol) and this shIlthead didnt even bother to edit it out!!!

Does ebay take any recourse? Probably not, right? Man, I am so mad!

Classic, under what policy do you report them? auction interference, copyright infringement or what?

I would think it would come under copyright infringement-sorry I cant be more help-its been at least 7 or 8 months since I did this.
I remember they emailed me back and in 1 or 2 days their auction was gone.

We watermark all our auction photos with our eBay ID and website addy. Hard to edit out and when an idiot does shoplift an image we can spot them easily (as can eBay when we notify them of a copyright infringement). Most picture/photo stealers are either newbies or PowerSellers - usual excuse is ignorance and laziness respectively.

Same goes for copyrighted text infringement as we regularly scan for key phrases included in our auctions listings... YMMV

Go to this URL and it will tell you what to do. I would first write, if no answer then I would report them. You have to show proof that they "stole" your image if you report them. Is the picture they are using an active auction of yours? If not delete that image from your vendio or replace it with a different image. Also check to make sure that you aren't being charged for that image. Good Luck

agit and libra, thanks. This is so weird. Maybe later I will post the pictures so the detective types here can tell me what they think. The hubby said to just watermark all the pictures from now on. I did write the seller. She denies it. Said she's been selling on ebay for years and 'knows' the rules, wouldn't steal from anybody, blah, blah, blah, Honest abe.

If I show you my pictures and hers 'supposed pictures' - it would be seem downright uncanny. I dont know what to think. But why would you see an auction running, and then put up almost the same identical picture (not just the item - the setting, surroundings) two days later? It doesnt make sense to me.

This already had me pizzed all morning and I took my auction down.

Did she copy the picture, or is she linking to it?

Sparkz, I dont know. See, I uploaded some pictures for this item and then I forgot about it and when I went to list reuploaded other edited ones because I had gotten better lighting, etc. but then I deleted the original pictures. Dont think she is linking though. Looks like she did some flipping and editing to them. I will bring them both in so everyone can see...ha...it is so weird if she did not lift my picture.
I took my auction down because I got so paranoid I was thinking she was shadowing me and using me to drop ship something she doiesnt even have or some crap. (I know its ridiculious, but ....)

Give me a few and I will bring all the pixs etc. in...but now have been looking and I dont know what I did with my original uncropped pictures....... I wonder if photo sensitive would be able to tell? Maybe I wam going off the deep end here! ..haha

right click on the picture and then select properties it will give the URL of the picture and you will see if they linked to you. If so you can change the picture to whatever on your server.

Do exactly as davebraun suggests. If she's linking to your pictures, it's costing you money. On the up side, if she is linking, we can show you how to get your money's worth, have some fun, turn your paranoia into ecstasy and cure her of her theiving habits, all in one easy step

You can do this, but it won't even slow down the theft. We had a thread about this sometime back and I took all the examples of watermarks and removed the watermarks in a matter of about two minutes and then reposted the picture hear just to show that really won't stop many from stealing the pictures.

Too bad that they didn't take your link though. Then you could have changed it to some XXX rated photos. Then that would how up in their auction. Then you bid and then retract your bid on that auction to make it non-revisable. Or even better, get a new ebay id and bid on it, then neg the hell out of the loser.

No, I don't think she has stolen your pictures. The shade is tilted different and your lamp has a label or mark on the front at the bottom and hers doesn't have it.

Edited to add that I think you owe her an apology.

ah,kiara, super detective! I knew you'd weigh in. Thank you for your opinion.

Yes, it is tilted different but the pictures are from a different angle. The label is a paper sticker which is on the front or back side.

edited to add: at that point I only posted it because as I said, it was "curious". Same lamp, same table with water stain in the same area, and the same white wall background. And I did say there were other pictures as I had several pictures and revised alot of them for two auctions.

You know, it always amazes me that you have to flount your moral judgements on posters here like you have a need to be somebody's mother or something? I know what the right thing to do is without your commentary but I guess you know just exactly what I typed in the email to the seller, right?

I hope you enjoyed looking at my auctions to store in your little judgement pack in your mind. You're so far up everybody's azz that posts here, you'd think you were a co-owner of Ebay or Vendio. (I bet you really enjoyed sucking down all the pictures of peoples desk and ebay rooms; not that you would post yours though.)

You're the one that talked about the pictures and put them on a public board. I saw both auctions and no, I don't think this seller stole your pictures at all. You got all bent out of shape for nothing here.

And your sarcastic comment is totally uncalled for, you asked they told you and you are dead wrong.

I think you owe the other seller an apology as you misjudged this without looking it over carefully.

Typical "I want everyone to agree with me" posting...

When it doesn't happen, they storm off in a snit... LOL

Kiara, Fenix and Trai are correct, not same picture... now unless you are saying they changed them?

Nero, I haven't been posting too much in the Outlook of late and if it matters, I didn't take much note of everyone's ebay rooms. If it makes you feel better, mine is a mess.

I made a simple comment last night. You put the auction links and pictures here on the board for all to judge and asked for an opinion and I said I thought you were wrong. Now you say you were only curious but you were the one blasting that other seller all day and your comments are still here.

Do you suggest I write the seller, or write ebay? I am really pizzed off. I feel like bidding thru the roof and npb'ing it.

I also have your post before you edited at 3:00 am because I'm used to people coming here and then wiping out their posts when someone doesn't agree with them.

Anyway she wrote me back and said if I report her, she is going to report 'me' for claiming false accusations!

Good! I hope she does.

As far as your other comment about me, it makes me smile. I don't tolerate fools and I call them out when they make false claims on these boards. So what?

Thanks, toasted. I've been helped dozens of times also because of this board and almost everytime I come here I learn something that helps me be a better seller.

Just one more thing to note here. There are no revisions made on the other seller's auction.

Nero made a minimum bid price quantity revision on hers.

We all come in here and ask questions. We expect answers whether we agree with them or not. Remember this is a discussion not a vendeta against anyone, well except Tomwii sig file, . When I come in and post something for everyone or anyone to comment on it's an open forum whether good or bad. I for one take most things and build on them. The one thing I can't do is raid the frige. I would be a blimp in no time. Try going to the Round Table and see what happens but everyone returns to post again.

Regarding the lamp. Resubmit it. That was probably a desirable pattern from Pfaltzgraff and maybe your price was the best. I would rotate that picture though so they can see it better. My opinion....

Evidentually I will get things right. Only 4 years here and still learning.

Bottom line, the lamp isn't a rare item and chances are that more than one will be listed on ebay at any given time.

Many people display lamps on wooden tables against light colored walls. And I have some in my home like that.

Twelve, you are meddling busy body with nothing but time on your hands and no real life. I didnt go off in a snit, I have other things to do in my life and dont sit on this computer 24/7. And in case you didnt know, what you did happens to against ebays rules emailing sellers you've had no transaction with. But Mr. Moral hating queers and all else thinks he is in the right, so be it.

And no, I didnt want everyone to agree with me. I posted it because I said it was curious, and so you could see why I had *thought* it was the same. I already knew how I was going to handle my business.

So Trai, I guess somebody made you the Class Monitor here that you can repost somebody's posts after they've edited it? Thats way more out of line than what I said to Kiara. (Or are you unfamilar
with that internet protocol?) But if your going to repost my post, you should repost the whole thing and what I said about it.
It was edited it out to preserve my identity but I dont really care now because that ID is going down. I guess what I said to Kiara so struck a nerve in you because obviously by your quick cacheing, you are one tailgating people. I bet you spend hours cataloging posts just for special occasions when you are really bored. Talk about house stalkers! I wonder how many times you've harassed others auctions because you didn't like what was said here?

I can say what I want to Kiara. If truth be known, I actually like her and enjoy her posts but I dont care for all this wagging your finger in somebody's face, which I am not the first one to speak about.

And I never proposed the lamp was rare. I sell normal or some novelty things in quality condition that people might want at a good price. I enjoy and like what I sell, thats why I do it. I've said before, I'm not trying to do this for a living, or be an antique dealer so if somebody shares information that is worthwhile to the board I appreciate it along with the rest of the posters. I don't think its commonplace for two different sellers that have never crossed each other on the wide world of ebay to post such similar pictures down to a water stain on a table. But your view to tell me that it is common, is only because you want to tell me I was wrong - because thats what you like to do. And as you said, so what?

And if I trashed the seller, at least it was amnonimously on this board.

You gotta be kidding, right? Once you posted those links there was nothing anonymous about it anymore, it became public.

Now your trying to hind behind it about protecting your ID after you put it there and slammed the other seller when you damn well know your wrong.

You got a lot of nerve calling someone a class monitor.

Stalker? Time for another valium. I don't have time for this BS and I don't stalk anyone. Your the one slamming others and now it comes back to bite you in the azz and now you whine. Next time back up your facts before you accuse someone but don't blame others when you put it on a public board.

Only you are responsible for what you type on this board.

Okay, everyone, calm down! Everyone is entitled to a mistake and I know each of us has made one. Thank goodness I haven't been slapped for each one I've made. I'd be walking around with welts covering 99% of my body.

neroter12 - Try not to take everything said so personally. I used to, but learned quickly that these are just opinions and when you post on these boards you are asking for opinions.

Personally, I don't mind if someone uses my pics as long as they ask, as long as they don't link to them or steal the auction descriptions and as long as the auction is over.

Writing to the seller first is the right thing to do. Running to eBay first is not. At least you didn't run to eBay only to find out you were in error.

Chin up. Oh, don't let twelve bother you. I disagree with him on a regular basis (don't I, twelve?), but I rarely let him get my dander up.
