I had a friend of mine who sells basketball tickets on ebay ask me this question..

If you have an auction that closes with a winner, but they never contact you after repeated emails, but then you realize that you had oversold the tickets to begin with, what would you do?

I had to think about it for a minute because I thought, well my friend should simply chalk it up to dumb luck that he didn't have to go back on his word for some tickets and end up with a negative for not delivering. But then I thought about the deadbeat who would have screwed him over, and as far as they knew the tickets were still available.

Hmmmm....

You can't have it both ways. The seller should be happy the buyer never contacted him. Can you file for FVF if the item has been sold before you file?

Don't do anything and move on... chalk it up to a learning experience
