I made an online purchase (from a web site, not eBay) paid with PayPal, total was 305.00 postage included. Before I paid I emptied my PayPal account & put the entire amount on my credit card to be on the safe side.
I didn't like what I bought, actually mostly jumk, & emailed the seller, she said return the package for a full refund. I used the return address that was on the package & also checked her address on PayPal, it was the same & verified.

Tha package came back today marked in three places. Attempted Unknown,(yellow postal sticker) Address unknown?(in pencil) & Return to sender not at this address.(Sharpie marker)

I plan to call my credit card company tomorrow but am wondering if I should make a claim at PayPal first, problem with that is it can take up to 30 days & if I'm going to do a charge back I can't wait that long. How am I going to get my money back if I can't return the package, I have no idea what to say if I make a claim & I'm reluctant to pay the 21.00 postage again for a second try to return the package.
Should I try a charge back on my CC, but don't know if that's possible because I have the package & if I do that am I in trouble with PayPal.
It's been 34 days since I paid PayPal for this purchase. I mailed the package back priority on April 16th.

I did not email her, thought about it, but I expect she would say send it again & my guess is it would just come right back to me for a second time.

Any ideas or suggestions are very welcome.
I really have no idea how to deal with this.

if it has been more than 30 days (you said 34) then you have no recourse whatsoever with PayPal. It's time to deal with the credit card company.

Thought so. Thirty days isn't long enough in a case like mine, never expected to see that package again.

Good luck- the fact that it is back in your possession may be a problem. I'd get on he phone with a CS rep at your credit card company tomorrow.

did you try calling the seller??
also call your credit card issuer as prior post suggested and tell them you have attempted to return to the official address.
Your credit card issuer will side with you on the chargeback if you have made attempt to return the package=keep the seller email and the wrapping of the package.
In a chargeback dispute,your credit card issuer has the final say.(refusal to accept returns or providing undeliverable return address do not go well with your cc issuer)

Did you contact the seller to verify the return address? Just because there is a return address on the package doesn't mean that is the address to return it to. I ship all of my UPS items through work (then reimburse the costs), but the return address is my work address. If someone were to return a package to me their, I likely wouldn't get it. I would instruct the person to send it to my home as a package cannot be delivered to a business if only the persons name is on the package. That would make it undeliverable.

I didn't appear that you asked for a return address in your posting.

The seller knew I was returning the package, I even received an email from her telling me to send it back. If the address was to be different she made no mention of it & if it was she certainly should have. The same address was also the verified address on PayPal, so I think it's the right one.

I called the credit card company today & what they were most interested in was the return policy. I told them I had an email saying to return the items for a refund. They said to send a letter with details & to be sure to include a copy of the email.
I also told them that I paid 22.00 postage & 21.00 to return the package & did not want to pay it again. If they find in my favor since I mailed the package & the address war wrong both on the package & PayPal I will not have to pay it again. If the seller wants the stuff back she will have to send me 21.00
Because of the email I have I think my CC will refund the momey.

What I don't know is what PayPal will do when I make this charge back.

paypal will scold you, but do little more...
Even if you didn't have the email, most cc companies are going side with their customer over a seller, as long as it seems plausible... you may still have to send the item back on your nickel, but would get the other refunded if you paid by cc and add that amount to the dispute.

i have seen cases like this before-customer ended up winning the chargeback and get to keep the item.
It is a punishment to the seller for not honoring his own return policy.
if the seller wants the item back,she should pay for the return postage,you may pay 306,but her cost is probably half of that.

The only mistake you made that I see is you didn't ask for the return address. To assume that they should give it to you was a mistake on your part. And we all know what assume means. The credit card company could reject your claim because of this, but it would likely be a small chance.

Never occured to me to ask the seller for a return address, but to make sure it was the right one I not only checked the package, I also checked the transaction & address on PayPal.

Remember I said her address was verified.
Shouldn't I be able to trust that HER address is valid if it's verified with PayPal?

As for sending the package back I will gladly do that if she pays the postage this time, in fact I will even go halves with her.

some changes are coming in regards to chargeback dispute,i will look up the effective date later.
both merchant and customer have only 1 shot at presenting their side of the dispute ,not 3.
Once you submit your side of the story and the seller submits hers,your credit card issuer will decide the outcome who wins and who loses.
escalation to MC/VISA board will cost 250 dollars.

This is a bit off topic, but occasionally, we have a buyer who doesn’t like the item when they receive it, OR failed to read the description, and then wants to return the item for a refund, and we do accept returns, with a restocking fee.

What to me what is funny, is occasionally, like recently we had a woman purchase 2 red feather boas from our Diva Las Vegas web site. She received them, and then decided she wasn’t the feather type. She originally paid $7.95 each, plus $5.65 shipping/signature/insurance.

She wrote wishing to return them, which my husband agreed to, and reminded her of our return policy. She said fine and she is returning them. BUT, in this instance, her original cost was: $21.55

Now to return them, it will cost her another shipping fee of at least $4.00, plus a 20% restocking fee $3.18, plus her original shipping/signature/insurance fee of $5.65, for a total of $12.83 out of pocket loss to her! IF in fact she truly doesn’t like herself in boas (and it isn’t that she wore them and then wants to return them) – it would still be more reasonable to give them as gifts to someone else in the future, than lose almost $13.00 by returning them.

We have a high restocking fee, and stanch return policies for our Diva Las Vegas web site, because there are some gals who will order clothing, wear them, and then attempt to return such. WE solved much of this by placing our private label, on a clip through plastic tab like Wal-Mart uses, and the attached label is now put in the middle of the front of the item. Items with the tag removed can’t be returned.

REGARDING REPORTING THIS TO YOUR CC company It still takes about 30 days to complete a chargeback, as the credit card company gives the seller time to fax or mail all evidence to them before the chargeback is permanent. It has been our experience, that the CC companies will honor the sellers return policies.

corrections to my prior post on changes in chargeback procedure-
Effective April 3 2004 Visa has made a significant change to chargeback procedures. In the past the consumer and the merchant could both engage in multiple chargebacks and replies. Now under the new guidleines you are both limited to one chargeback and one reply.
Arbitration of the chargeback dispute is available at $150.00.

Only thing mentioned was a 60 day limit to start a charge back.

So far there is no charge for a charge back. I will absolutely send the package back if the seller & I can agree on postage. I think she said she will take the items back & then later regretted it & is pulling something about wrong address. Remember the package sticker does not say refused it says "attempted unknown"
The other two notations were hand written.

That is a very good idea.

The sellers return policy was, return for a refund.
Problem is the returned package came back to me.
