I bought a DVD for my mom on eBay and paid with PayPal. I paid $20 for it. I normally wouldn't have paid that much for movie, but it is her favorite. It is very hard to find on VHS and impossible on DVD. The seller's feedback wasn't too bad either.

I got the DVD today. The problem is it's not a DVD. It's a DVDR. I went back to the auction. No where on that auction does it say anything about it being a DVDR. If it had, I wouldn't have bid on it.
I am willing to pay him something, but not $20. I am going to e-mail him and ask for a refund. But should I file a chargeback with PayPal? Do I report this to eBay?

Sounds like a typical scam from YAHOO auctions!
Every VHS I bought on YAHOO was a copy -- & I always insisted upon a refund.
These are totally ILLEGAL, NTM unethical and contrary to feeBay's TOS!
When was EOA?
You have 30days to file with PP, so I would give him a 3 day opportunity to REFUND yer PayPal payment...
If he don't respond, then, by all means, drop a load of Bush on his head & FILE with PayPal, feeBay, Dudley Do-Right, etc, etc...

I did a BIN and paid on the 28th so I have plenty of time.

A DVDR is the same as a CDR. It was recorded. It is not an original.

I would love for the Don to pay him a visit. Just don't use the horse head. I wouldn't want to do that to the horse. I can think of a couple of other heads he can use though.

you cannot file chargeback with paypal as it does not get involve with 'ITEM NOT AS DESCRIBED'.
does it have USPS dc ??
if not,just say you did not receive it.

1) Fraud investigiation through eBay
2) Immediate paypal chargeback
3) Immediate negative feedback
4) Turn him in at www.mpaa.org
Don't play games or even bother to contact the seller. Just hit him with everything you've got.
This kind of thing REALLY ticks me off.

As a seller of movies, I hate these as well. Paypal chargeback may not work as someone said because if they show it as delivered, they may not get involved.
I had this happen last year, I paid a lot for a tv movie my wife wanted - What I got was a home copied job. The seller tried to explain that because it was out of print, copyright had expired. As someone with a background in library science and copyright, I definitely know this NOT to be true. Anyway, I thought about it for a second, and decided to contact the seller and be nice about it, figuring I wasn't going to change their ways as it was the way they set up their business. I told him that I was very unhappy to receive a non original movie, and I wanted a full refund including shipping. He complied, and that is as far as I had to take it.
If he had refused, then I would have gone through all the steps, but he didn't refuse.I would ask for a refund

ebayvet, it's not really the same thing.
Your seller MAY have been some guy taping old TV shows who honestly believed that the copyright had expired because the movie wasn't otherwise available. This is legally wrong to be sure, but it's a common misunderstaning of copyright law. An explanation MIGHT be in order before setting the dogs on him.
However, a guy copying DVD's cannot make the same excuse. There's not a DVD in existence old enough to use that excuse.

Find a DVD copy & sell the SICK FLICK for $300! UPDATE: I stand corrected! Looks like CRITERION COLLECTION has re-issued it & Amazon has USED copies for $25 now...

PS: WaterBearer Films only produced his DVDs for about 6 minutes before pulling da plug!
I found a copy of his "Arabian Nights" in a junk store for $7 & sold it in 5 minutes for $99

I realize there are plenty of "rare" DVDs out there. I can think of several too. But that doesn't mean they are out of copyright.

I paid for a DVD, not a copy of a DVD.
Here is his offer. He will refund my payment if I sent it back. But he will not pay the postage for me to return it.
I just filed a chargeback with PayPal.

Actually replaymedia, it is exactly the same thing - This wasn't an hour of a tv show, this was a mini series that is out there on VHS, just is very rare. Also, he had his own special packaging, and an "explanation" that everything he did was legit. His entire business was selling rare videos at high prices, but giving people taped copies of those videos.

By the way,there is no such term as paypal chargeback.
you file a complaint with paypal,
you file chargeback with your credit card issuer.
Paypal does not get involved with item not as described,unless it is an item paid for via the time installment plan with GECC and is GROSSLY NOT AS DESCRIBED.
In your case,it is a 20 dollars item and not paid thru installment plan.
The proper way is to go thru that Ebay square trade procedure which you have to pay 15 dollars and get no satisfaction.

I did file with PayPal with the reason that the item was not as described. It then takes you to a second page where you are given more options. It is like reading "Filing a Complaint for Dummies". Anyway, there is an option for fake, forgeries, and pirated items (cd's, etc.).
He answered that he would give me a full refund, which he did. The money is back in my account.
He also left a note for me to return the DVD asap. In my last e-mail I told him I wouldn't sent it back if he didn't send the postage.
One other thing, I didn't mention that this guy is from Canada.

Send it back to him via UPS. Declare the value on the customs form as $100.00. Don't use your real name or address as a return address.

My understanding is that if you received anything, even an empty box, paypal won't get involved. But what about the new ebay procedure if item is "not as described"?
As a last resort, you can file directly with your cc company, and they will refund. Tell them you were sold something different that what you ordered and what was sent to you was an illegal copy. You will be refunded the entire amount including shipping.

when you file complaint of item not as described,paypal would issue a stern warning to your seller saying no action is taken but paypal takes this kind of complaint seriously and will keep it on file bla bla bla.
There is a guy who posted here once saying paypal even pull a credit report on him and terminate his account !
whether your credit card issuer will agree with you on chargeback,depends on the credit card issuer,some are saying since you go thru a third party like paypal,you should take your issue with paypal.
