I recently won an auction for a mannequin. I got a pretty good price because there was damage to the hands which didn't worry me because I could replace them.
Well she arrived yesterday and looks like she was in a car accident or something. I wrote the seller and he said he would file a claim with FedEx.
Ok that fine but to be honest his packing job was the pits. I know it's not up to FedEx's standard.
My question is this - should I ask him for a refund before I release her stating that FedEx will either refund him or return the item to him or should I just wait to see what happens.
If it doesn't come out good, can I file with Paypal (I used my account balance) because I don't have the item any longer?
I don't want to be out the mannequin and my money. HELP
I know - I should just stick to selling!!!

I don't think PayPal will do anything in this case. I don't think they don't cover crappy packaging. I'd wait to see what FedEx does. To be honest, I won't use them or UPS anymore. Everytime I've sent a breakable item out using either one it has arrived broken. The same is said about breakables I've received that were shipped through them. In one week I had to get insurance money on TWO different packages sent by UPS. They looked like they were stomped on. On the other hand, I've never had anything arrive broken by USPS. Well, once I did but that was my own fault. I was new to selling breakables and I didn't do a good job packaging.
The seller should refund your money and take the insurance money themselves. At least, that's what I'd do.
Edited to add: The UPS insurance filings I did did not require giving up the items. They didn't even come to look at them. However, don't throw the item away. They reserve the right to come back later and see it. I don't know if the same holds true with FedEx.

depends on how much is involved,UPS can get nasty when someone filed complaint with old stuff bot on ebay .
paypal would not get involved as seller has delivered the item with online trackable dc.

I emailed and asked him if he would refund my money as soon as FedEx picked up the item (as they will refund him or ship it back to him) and he said he would as soon as they "Refunded the Money" so I'm back to square one. I just don't think they will refund anything on his packing job. This mannequin is the type with plaster and his idea of wrapping it was a large plastic trash bags over the two main parts. Loose newspaper as filler. So the other parts banged into the body from Iowa to Florida.
He has good FB but there was damage that wasn't listed in the auction that happen before it was ship (which he admitted). Just a bad experience all the way around!!!

I have shipped FedEx for 3 years and they have NEVER broken anything. I sell crystal, china and lots of fragile items. No carrier can make up for bad packaging. When I buy on Ebay it amazes me how poorly some of the items I receive are packed. Seems some sellers never even think about what a package has to go thru before it is delivered.
I have even "drop tested" my own items to make sure they will arrive in one piece.
I would rather break it myself than to have a customer open a box full of broken glass.

how much is involved??
you are just assuming Fed Exp would not reimburse him,may be they will,esp if it is under a certain amount,say 100 dollars??

It was over $100.00 but not much.
If it were me I would just have FedEx pick it up, refund the money, and get on with life. But I would never pack a fragile item like he did - I don't think he believe FedEx is going to pay either - the only way they will is if I make it look like he packed it better than he did. Even then - are they going to reimburse the shipping cost? They could even deny the claim due to the prior damage (re-glued stuff and things like that)- it just wasn't like he said it was before it was shipped. I'm a little p*ssed off about the too!!
Now I'm really kicking myself for passing on a mannequin at an estate sale for $60.00 - wig and all - that was a few years ago.
