I recently sold a VCR remote from a VCR that went to the graveyard. Person received it but said that it didn't work (said that he'd tried two sets of batteries but no dice), and asked if I'd take it back for a refund...his words:

"Thanks for taking good care to ship the remote. I've taken care to program the remote but it won't operate the JVC VCR remote or the Panasonic Television. Can you tell me what the return procedure is? It does not work on two sets of batteries, so I believe it is safe to assume it is somehow inoperative.

I've purchased a brand new unit from JVC at considerably more expense, but I just did not want to toss the old VCR."


I receive the remote back today but find that there's nothing wrong with it (at least as far as I can test it...works on my Panasonic TV and all the buttons function and transmit). Now my question...I know I'm going to have to refund his payment and shipping but should I also refund his RETURN shipping since I can't find anything wrong with the unit?

No, don't refund the return shipping. It wasn't materially (or otherwise) misrepresented, and you were kind enough to give him a refund based on his representation that it doesn't work, which was incorrect.

I agree with Claude on this one. Don't refund the shipping. That goes for the cost of shipping the item to him and the cost of him shipping it back.

What is your guarantee? If you didn't agree for return shipping then I would only send him the amount he paid.

I could've been really rotten and told him to take a hike as my auction CLEARLY states:

"Unless noted, all sales are final and sold as-is, where-is, unless it is determined that seller misrepresented an item."

(nope, didn't misrepresent--SPECIFICALLY stated that the item MAY work with other applications but was buyer's responsibility to determine, and it is in fact in WORKING condition)

That said, I'll refund what he paid me for it (item cost + shipping), but not return shipping. I'll see if I can get the seller fees back and contact the second chance bidder to see if he/she still wants it.

In case you didn't know, you can get your seller fees back by going to unpaid item disputes, select mutually agreed not to complete this transaction and there will be a selection for item returned. The buyer must complete his end when he gets an email from eBay. Make sure you have him do this BEFORE you refund. He's under no obligation to complete his end if you refund and then ask him to do it. It won't go against him and you'll get your fees back.

You're welcome, Jack. Glad I could help. Actually, a customer told me about this when he returned an item I sold him. I've been thanking him ever since!!

2 questions

1) Did you clarify if you would pay for return shipping? If you didn't, then you are probably off the hook

2) If you did, how much did it cost to get it back? I imagine a remote control would have to be $3.85 or less, now ask yourself how much avoiding a hassle is worth to you.

WOW!!!!!! the e mail from e bay just came in,,,,,,,you are no longer under ANY obligation to the buyer, blah, blah, blah,,,,,,,Oh Yeah? I think NOT!!!!!!
