I have some really nice old English china & I usually don't sell out of USA, but for this set I am selling to England & Canada. This lady wanted to bid on some cups & saucers, but wanted to mark on the custims slip as a g\ft. I told her no, couldn't do that. So she emails back that Canadians can't buy in US because of the high duties & she would not be bidding.

boo hoo, she won't get the item. my spouse is canuck - they know what the deal is with imports/duties. knowing me, i would have lost my temper and written and said "don't want your business because i won't lie for you...put that in your pipe and smoke it, eh?"

Well, sucks to be her! I hope it wasn't anything "important". She knows all about customs and should bid accordingly.

I agree that one shouldn't lie on customs slips, but I have to feel bad for Canadians trying to import things. Canadian customs fees are silly high.

I keep remembering my favorite clerk at our little p.o. telling me, months ago, to just check "gift." He's worked here for years and years and everyone likes him. I did it the time he told me to but don't do it now.

Honestly, could we get in trouble somewhere by following orders of our p.o. clerk? Just wondering.

I'm a Canadian - and believe me they know the rules. Don't go for this con. I ship to Canada and if they ask me to put it as a gift, I ship it anyway but never x the gift square

I live in Canada, and customs duty can be very high, and just not make it worth buying on the US site. Thankfully we have kids in the US, and we can get things sent to them, otherwise, unless it is something you really want, it just isn't worth it. Of course, not every item is checked, and some things get through without duty, but there is always the possibility of a hefty duty.

Yes, no clerk has the authority to tell anyone to break the law.

A very nice friendly clerk told me to mark it as a gift and her supervisor set her straight right quick!

Sanmar...You did the right thing. Under no circumstances should you ever doctor a customs form on a shipment to Canada. I was in the international shipping business for 40 years, and I can assure you that when it comes to dotting "i's" and crossing "t's", there can be no one more difficult to deal with than Canadian customs. They rank right up there with Mexico, Brazil and Saudi Arabia. If they catch you cheating, that package could wind up back on your doorstep, postage due, or it could get lost in the system, or they could receive it with a bill that could send them into cardiac arrest. It's not worth the risk and you don't need dishonest bidders anyway.

I don't know what the percentage is but it's got to be way up there. Years ago I sold to Canada and was ask to mark as a gift. I say I would (1st mistake) and forgot. I offer to pay the duty for her after all it was only a $25 item. Well as it was insured for up to $50 - I guess that's what they used for value and the customs was $17. Expense lesson but I won't ever make that mistake again.

Your first mistake is to inflate the item on the insurance form.

I marked it for the amount she paid on the insurance form. My USPS clerk could have marked it as $50 on the customs form - but I didn't "infate" anything.

I sell lots of items to canadian bidders and usually mark it as a gift-

Are there really negative circumstances I could face by doing that? If so, what are they? I don't want to be endangering myself..

My auctions all say "Customs forms for International orders will be marked with the final auction price. NO EXCEPTIONS." and they don't request this anymore.

I don't included shipping costs in the price marked, but always mark as merchandise.

Men in red uniforms and funny pants could come kidnaps you and drag you secretly across the border to prosecute you in Canada from denying their pisspoor customs department with an additional $10 that they would have paid some guy to sit on his ass and watch your package collect dust in a customs warehouse until 1 day after the PayPal dispute your buyer filed for non receipt clears.

By the way - does anyone really think that the US government is going to send the customs form cops after you for denying a foreign government money?

Yes. They wouldn't come after you because of denying a foreign government funds, but for FRAUD on an US Federal Form. It's called reciprocity. We police it here, so the other countries will also police it.
