Hi

I sold this necklace Feb 19th.

She contacted me a week after receiving it and said that I made a mistake in the size, and what do I want to do. So I said ok then send it back.

She said ok that she will send it back

I was holding the funds aside in paypal so I could give her the refund and week after week pass by and she didn\'t send the necklace. I emailed her twice in that time telling her that she is taking too long to return it, so please send it back right away since so much time is passing. I never get an email from her. So I use the funds.

On March 18th she writes and said ,. the necklace is being sent back as I write this email, and she is sorry it took so long. She was in the hospital having surgery and its just the beginning of all the surgery ahead of her.

I email her telling her I\'m sorry to hear of you problems but now your problem has become my problem. I don\'t have enough funds in paypal right now since I stopped selling on Ebay for a while. So I will try to have the funds in a week. She didn\'t answer this email. I also told her I need to file for my fvf before I return her money.

I was going to return to her the bid price and shipping plus even shipping it back to me because it was my mistake since I wrote down the wrong size. But since it took her over a month to send it back to me I want to only return her bid price do you think it\'s ok if I don\'t return shipping ? Do you think I am wrong? or should I still return her shipping also.

Also, if the item shows that it\'s paid \"In My Ebay\" can I still file for my FVF before I return her money through paypal.

I have no problem taking back this necklace It\'s a beautiful item, but now do you think I could have a problem since I have the necklace and the money?.....I hope she will give me a week since she held my necklace for a month.

I would not return shipping. I wouldn't even have taken it back after all that time. You can file a dispute. There is a part that says she returned the item and you are refunding. You'll get your fees back, but you'll have to act quick. I'm not sure how long you get to do that.

I assume you measured correctly? If so, I would not refund shipping. If a mistake was made, I would refund shipping.

She made you wait for a month. She better be able to wait a week.

Yes, I'm the one who had the tiny neck customer.....lol

I measured correctly but I got distracted by my 4yr old grandson and I copied the wrong size into the auction. I was off 1/8"

I have been having so many strange buyers lately that I stopped selling for a while, I needed a break.

I have so much Vintage SS Jewelry to list but for some reason I have no desire to get back into selling right now.

I also hope she don't make a claim with paypal this has been bothering me also about this whole mess.

When you receive the neklace, just send her a check. You do not have to refund by PayPal.

As to returning cost of shipment to and from - what are your terms which were posted in the item description, regarding returns?

edited to add: I see what the terms are. It's up to you.

If you pay by check, you had better completely trust her. Additionally, you won't get the PayPal fees back.

I always made it a rule, as I believe most merchants do: you'll get a refund in whatever form you originally paid in.

Cash, Thats why I want to refund her with paypal.

I listed the size wrong by 1/8" like I said so I kind of feel it's my vault, I just feel she should have sent it back sooner.

She emailed me telling me she would agree for my filing of the FVF. She also said, she will wait for her refund till I have funds in paypal account.

So I guess since she is being understanding I should refund her the shipping money too.



Max, 1/8 less is a lot I guess, maybe she was hoping I would have given her back some money because of that error, who knows.

The first mistake I see is the fact that you e-mailed back asking. "when are you going to send it back?" This to me is just asking for trouble. Once you told her to send it back the first time, it should have ended there. As far as you should be concerned, it's on them to send it back, not for you to beg it back.

That said, refund the purchase price only, not the shipping.

kozersky-If she refunds with a check the buyer can still file with paypal. Chances are that paypal will refund the buyer before she has the cashed check back.
1/8" isn't anything - sounds like she was looking for any reason she could to get a refund. When you start listing again, you may want to use approximately before all your measurements. I always do - even if I'm 100% sure.

Ladyjewels is correct. I would refund with paypal as that is how the buyer paid and she could still file a claim. You never know what they might do. I would probably refund the return shipping if it was your mistake in the description. Do you not have a credit card or bank account tied to your paypal? I guess I don't understand about waiting for the funds to be there.

I guess for some items, 1/8" can be important. I had a potential bidder question my measurements for the diameter of a cup. I'd said "about 2 3/4 inches" and he said that similiar items were generally 2 7/8 inches. I also thought that was nit-picky but apparently it was important to him.

1/8" doesn't seem like much - yet when you talk about a pendant that is listed as 1/2" X 1/2" (4/8 X 4/8) but is really 3/8 X 3/8 it IS something (25% smaller).

I know when I first bought things on ebay I'd order "pendants" that arrived much smaller than I expected. I never measured them but I am pretty sure they were listed at the right size, I just wasn't good at visualizing the size. Small wonder that jewelry sellers don't use dimes or something like that as a frame of reference in their listings.


I'll bet your buyer thought that the pendant looked smaller than she thought and when she measured found you were off 1/8" (her luck - she probably would have thought that 1/2" x 1/2" was small too).

For some reason I was thinking the chain was smaller. I guess on the pendant itself - it does matter (some) - also may on the cup - sometimes depression glass size is really important, for example.
I might add that in my TOS I state that I use approximate measurement but if you need exact, I'll be happy to provide them.

Deichen and Ladyjewels, thanks for answering Bill K's question; I slept in this morning and it was FABULOUS. I haven't done it in at least two years, and I needed it.

I wouldn't trust PayPal to acknowledge a copy of a canceled check as proof of refund and furthermore, there's probably some clause hidden in their user agreement about refunds being via PayPal. OTOH, if you trust the buyer (and why would you?) not to file a dispute with PP, then I guess it's okay.

1/8 smaller does make a difference so I do understand it was my mistake so even though she took so long to return it I guess the right thing to do is return all her shipping .....since I made the error.

I have no problem taking it back I was just upset that she put me in this position because she waited so long to return it. But I will figure something out.

Stone, the only reason I contacted her again was because it was taking so long for it to arrive and I needed to use the money that I was holding for her, so since I didn't hear back from her I used the money. I can't keep holding money for whenever she feels like sending it back.

Another good reason to refund via Paypal if payment is made thru Paypal is to get the Paypal fee back.
We have up to 60 days to do so.
