I sniped a great cake stand tonight cheap, cheap. Immediately the seller emails me and gave the tired old story how the shelf that held the two cake stands he had listed and it fell and broke yadda, yadda, yadda. I told him I had been around Ebay since 1998 so I wasn't very trusting and to send me a picture of the broken cake stand that I won. He replies that he has already put the broken pieces out with the garbage that will be picked up tomorrow but that he can send me a picture of his cut hand. I followed up with the fact that I do mosaics and can still use the pieces so don't dispose of the garbage unless he wants to be in negotiations with Ebay. So now what do I do? What kind of complaint would this fall under with Ebay?

I don't think there is much you can do, but your doing a great job at making him squirm. Keep at him, he deserves it.

Things do get broken but with a camera so handy there was no reason not to photograph before taking it to the trash.

I have all but cried while packing a nice item that sold for a fraction of the value but I do it and chalk it up to "don't list that low again".

I'd report him - you never know, he may make it a habit and ebay should know.

He shouldn't be bragging "No Reserve!" if he isn't prepared to let it go. Here is what he posted last

"LOOK...I HAVE CHILDREN AND ANIMALS AND I AM NOT GOING TO DIG THROUGH THE GARBAGE TO PLEASE YOU...DO WHAT YOU WANT THROUGH E-BAY, BUT THIS TRANSACTION WILL NOT BE COMPLETED...HAVE YOU EVER MADE A MISTAKE OR ARE YOU ONE OF THOSE BUYERS....I TRIED TO REMOVE THE COMPOTE WHEN I BROKE IT, BUT I COULD NOT...AGAIN, DO WHAT YOU WANT, BUT I WILL NOT DIG THROUGH THE GARBAGE, BECAUSE YOU ARE A NUT"

He doesn't want to set a bad example. Once the kids and animals see him doing it, they'll be ripping apart all the garbage in the neighborhood.

Please! Please forward that note to eBay's T&S so they can see what kind of seller he is as well!

I think his argument about digging through the garbage might have been because of "what" might be in there that had come from the kids and animals. We have cats, but we don't throw their poop away in the garbage can. I wouldn't mind digging through my own garbage... Actually, that's what his argument is - garbage.

It's not like this is a rare, one-of-a-kind item that would make you rich - give the guy a break and get over it. No reason to be vindictive.

And what if, just maybe, possibly that it actually broke - I've had it happen - had the buyer asked me to pick through the garbage for shards of glass - I wouldn't have done it for anything in the world.

If it really broke don't you think he would have been smart enough to take a picture of the broken item?

As a seller that would have been the right thing to do and then let the buyer decide if they still wanted it.

A few times this happened to me because I wanted to clean the item before packing it and I damaged it, I took a picture and let the buyer decide what he wanted to do and I gave a discount if they still wanted the item.

My guess is he already sold it somewhere else and didn't realize he still had it on ebay.

I would let it drop. Why? Because you still have your money. Would you want to buy from a person who isn't honest anyway?

I have broken a few items I have sold on Ebay or discovered a chip or found a box that should have an item in it and it was empty, etc. Things happen. No has ever accused me of misconduct or asked to see a pic of the broken item.

I'm with toni on this...that's exactly what I've done the couple of times I've broken items (or found damage I didn't notice before listing). I e-mailed the buyer immediately and sent photos...and apologized profusely! In all cases, the buyers decided they wanted the items and I gave them a discount. I also wouldn't go through garbage looking for glass shards BUT I suspect this seller was being less than 100% truthful.

I'm with Caroline. I don't think anyone has seen rocketing bids on eBay lately and are unwilling to see the item go at opening bid. I hate to say it, but sometimes I lose cards or have unwittingly duplicated listings. If the buyer has already paid, I refund and apologize for the error. What else can I do except make them "whole" - in the same condition they were before the transaction?

what if he stuff something into a box and ship it to an address in your area with DC,then he has proof he shipped the item and you lose Paypal dispute.
Would you rather see that happen/?
tell him you are willing to pay more.

I would be leery. I don't think he's telling the truth either. However, it's not worth the trouble. Move on. No one can force him to sell it if he doesn't want to and why label yourself as vindictive over a cake plate? Sellers are now looking at feedback left so be careful in what you say. "Vindictive" is liable to get you blocked. JMHO.

Usually if I've lost something (twice this month with coins) or broke something, I refund and send the buyer a freebie to show I'm sincere. I've never had an angry buyer yet over one of my boo boos.

Hopefully not very often -- this problem is getting some of eBay's largest sellers kicked off the site.

You can say that it's a sloppy way for them to do business, but if you have 500,000 items in stock how often can you afford to do a physical inventory? eBay margins just don't allow for that.

One huge media seller is about to be NARU'd and others will follow shortly unless eBay does an about-face. This is not good for buyers.

If he's that dishonest, what's to stop him from breaking a worthless piece of glass in to millions of pieces and taking a photo of it and sending that? Maybe he could just keep one photo on hand for any broken glass photo request?

How's this for an idea for a website idea - brokenauctionpics.com - for a small fee you can download a photo of a particular broken item to send to a buyer?

By the way, I checked the auction, it was NOT an EAPG cake dish, it was a cheap pressed glass one. Barely worth the selling price & shipping cost IMO.

Don't the media sellers' problems stem from not really have the inventory in the first place? I thought I read that many order from the same catalogue supplier and those inventory counts change daily.
(they get misfiled). Ebay mysteriously relists sold items or burps and lists things twice every now and again too. It's nearly impossible to catch these things when you have thousands of items listed.

Nope. True, that was what got GlacierBayDVD (Randy Smythe) NARU'd, but that was a couple of years ago. The focus has changed.

I'm talking about people who sell used media. There would be no point in listing things they didn't think they had in stock. One of these sellers has (or had) DVDs from a huge online DVD rental company.

It's nearly impossible to catch these things when you have thousands of items listed.

Too true. I only have 700 things in my eBay store and while I realize my sales would increase if I added more, adding more also creates potential ID-killing problems.

Sometimes things do get broken.

I know it is frustrating, but it is possible the seller is telling the truth.

Now wait a minute! I have been listening to everyone's opinions and mulling them over whether I agree with them or not. BUT carolinetyler, I do have to say that in my area that cake stand goes from $45 - $50. And they sell very fast at that price range. Cheap? NOT
