In a postcard description today:
I will be listing some really nice postcards at a starting bid of only 50 cents.. However shipping charges will be $2.99. I can do it this way to prevent ebay from getting a higher selling fee. If you disagree with this please do not bid and if you win please do not leave bad feedback because of this promotion. These cards cost me a lot more than what you are getting them for.. I just have way too many postcards and there is just too much competion [sic] on ebay now. Thank you
If this card sells for over $5.00 I will reduce the shipping fees to only $1.00
Sorry there will be non s/h combine charges with this promotion

If you have any serious competition in your category, I wouldn't do it. Unfortunately most of these rule violations that end up being enforced, are not because eBay was looking for it, but because someone else tattled.
It's fee avoidance in eBay's eyes, when you spell it out like that anyway. If you just say that's what the cost of shipping and materials happens to be for you, no rules broken.

Thanks, Christopher! I wouldn't dream of ratting this seller out; I've bought several items from him for our museum in the past couple of years. I was just curious as to whether it was "legal" or not. I appreciate your explaining the difference; he shouldn't be saying WHY he prices things this way.

Why not just sell them for 50 cents each and simply leave out the reason why. The shipping cost isn't way of wack to begin with. Why suggest to anyone that shipping is high? That is like putting gas on the fire.
