Hi

I've sold many vintage cars on Ebay Motors and I'm not sure which is the safest way to handle this

The car sold to this fellow two weeks ago, he said he could come only on Oct 4th so I say that would be ok. I had sent him an email asking him what time he was coming but he never got back to me.

Then he emailed me (2 weeks later) asking me a question about the car so I told my son to call him and let him know that anything he wants to know to just call you and you will ans. any questions he has. The fellow never called my son back.

Today I get an email from him saying he can't buy the car something personal came up. He also offered to pay any fees it cost to list the car (cost was 2.00 in pictures)

My problem is that it cost $125.00 FVF to sell so I was thinking of asking him if he wanted to do a mutual agreement that we both decided not to complete the transaction.

But the more I think about doing it I'm concerned because what if he don't agree will I loss my FVF and not be able to file for FVF since I sent him the mutual agreement email? And I'm also concerned that he takes weeks to respond to emails so where does that leave me if he doesn't respond to the mutual agreement email?

Now I've never filed for a FVF back on ebay motors so I don't know what's the best way to go about it.

I thought on Ebay motors,you just pay 25 dollars listing fee and there is no FVF?
Why dont you give him a call and chat with him?
If he knows you are not forcing the sale on him,he should agree to helping you get your FVF back.

If you start the non-paying bidder process takes 10 days till you can actually file for your fees. During that time, the buyer will most likely contact you, because eBay will be contacting him. At that point you can discuss with some leverage what will take place.

My concern is that he doesn't return emails and he doesn't answer his phone, when you leave a message asking him to call you back he doesn't.

I don't want this to take forever so I am looking for the best way to handle this for me because he made me wait two weeks already and now backs out.

So Max are you saying that I should just file for my fees and if he contacts me then I could try to work out something with him but I am concerned about sending a mutual agreement because if he don't answer it where do I stand?

Because once I did send a mutual agreement for an ebay item and the person never answered the email and I never got back my FVF. I don't want this to happen this time, that's my concern.

Offer the bidder the opportunity to pay both listing and FVF's. If he doesn't accept, file non-paying bidder for your final value fees and hope for the best.

You wait 7 days not 10 days to get your FVF back,unless Ebay motors is different.
If he is not answering your email and not coming to the phone,these are 2 obvious signs he does not want the car.
I would just file without contacting Ebay,it cant force the bidder to pay.
Lots of people getting pink slip,getting their credit card line of credit chopped and watching their stocks tanking daily,very bad out there.

You wait 10 days to file NPB, which you already have. If it doesn't result in action by the buyer, after 7 days you can file for your fees. IF BUYER DOESN'T RESPOND TO NPB ALERT, HE CAN'T LEAVE FEEDBACK.

Since when did Ebay change Ebay motors from 25 dollars listing fee and no FVF to low listing fee and FVF >
There are many dealers selling cars on Ebay,so if they sell a car for 18k,what is the fvf?

There is no listing fee. However, there is a successful listing fee of $125.00.

In policy, there is a statement: " ... you'll be charged a Successful Listing Fee, whether or not you carry out the sale with the buyer."

I was checking ebay motors on how the FVF works, it stated:
You're charged a Final Value Fee (FVF) if your item sells or ends with a winning bid. This fee applies whether or not you complete the sale with the buyer.

In some cases, for example if a buyer backs out and doesn't buy the item, you can request a Final Value Fee Credit.

So I think the best thing for me to do is file for my fees now and worry about the buyer once he contacts me.....if he wants to pay the fees then great other wise I will have to file because I didn't read anywhere that you could both agree not to sell the item. Maybe I missed it?

I figured I would give him a chance to make good what he said he wanted to do (pay my fees)

this is what I sent to him

It cost me 2.00 to list for the pictures and 125.00 for the finial value fee to ebay. If you want to pay me 127.00 in paypal ....paypal email xxxxxxxx.com. If you don't want to pay me then I will file for my fees from ebay and see if I can get them back. Please let me know by tomorrow because I waited quite a while already.

What they mean is they will either credit your PP account or your sellers account.

toni, I wasn't selling a car so this may be a different set of rules.
I wanted to be nice to a buyer that politely backed out of my auction so I filed for FVF stating mutual agreement not knowing that if you choose mutual you do not get your FVF back.
I never filed mutual again, never will. If you give a deadbeat a break you pay for it, eBay sees to that.

If I were you I absolutely would not file Mutual Agreement.

Thanks mcjane for your good advice. I also did what your saying and I lost my FVF also.

That's why with all the new rules i'm unsure what to do, but as of now I did email the buyer as he offered to pay my fees I am giving him till tomorrow to respond to me. If I don't hear from him I'm filing for my fees on Mon. and I hope that goes well.

I felt before I filed I had to email him since he did offer to pay the fees but I don't think he had any idea how much they are.

If he can prove he never bid on your item,say his account was hijacked or his underage kid bidded ,then the bid would be nullified.
But since he has emailed you and said due to personal reason,he cannot complete the transaction,he knows what he is doing.
