This is one sad sad story, and maybe someone here can help me. I got a negative feedback and slandered for following ebay policy. I spend an hour on the phone trying to get it removed.
a guy bids and wins an item from me. He pays for it via Echeck. He writes me immediately asking me to ship by the weekend. I write him back telling him I cannot ship until the echeck clears, which is about 7 days. He gets pissed off and sends me an email stating ship immediately or send me a refund. I write him back telling him I cannot do either, because paypal will not ship, and I have not recieved his money to send his money back. Both are per paypal's rules. I request a cancellation, he agrees. The sale is cancelled. He gives me bad feedback THAT IS A DIRECT RESULT OF FOLLOWING PAYPAL POLICY. They have a lot of abusive emails from him saying I must be having financial problems and puts that in the feedback, even though ebay and paypal wrote him and told him I was following proceedure. But ebay told me that they cannot remove the feedback. Ebay screwed me. How can I fix it? They also say I cannot refuse echecks. What a pile of.....

I still don't understand how ebay/paypal can claim immunity by the internet content laws if they are part and parcel to the situation.

It was their policies that created the problems. I did everything right, and the ebay supervisor told me that I did. They said just "ignore it and move on". How cold can you get. It is not their reputation and name on the line for it.

Lets see,
You two decided to cancel the transaction but the echeck is in limbo?
So when it clears ,you wil have the money and you still have the goods.
So what does it mean?
May be you can ask him nicely if he wants his money back,he should remove the neg.

When a sale gets cancelled by the buyer's request, no feedback. If the sale is cancelled by the seller, they can leave feedback.

I never recieved the money, in my world the item was never paid for. It was kept in a "pending" hold account (possession by paypal) when the buyer wrote and said "either ship immediately, or refund, I could do neither. I then ask the buyer to cancel the sale, he agreed. Then he sent the following email.

I agreed to cancel the transaction so are you going to refund my money now? Pay Pal isn't showing a refund???

My response

If you agreed to the cancellation, it will take paypal several days (I am guessing) to credit your account. The check never cleared, so I am not sure what they do. Getting your money back is up to pay pal, I never received it so I am out of the loop.

Never the mind, I see the payment cancelled in my Pay Pal.

I'm glad you never got my money because you probably would have kept it and never mailed the merchandise anyhow. That's the way of things on here anymore.

Yeah that's some pretty bad FB, but I don't think you helped yourself by using profanity in your reply.
I don't know what you could have done in this situation other than what you did and I think ebay should remove the FB.
You probably would have a case for slander if you wanted to take it that far??

I used the word "ass". That is NOT profanity. It is an animal and describes a stubborn animal's behavior. This guy was stubborn not to understand it was out of my hands.

I am careful never to ever swear, but number 3 is in the dictionary, and is NOT profanity, though a real descriptive moniker.

But you are right. The ass lives in the same state I do. He also runs a successful recording studio and he paid the echeck from that studio, so the business he owns now becomes part of a law suit if I so desire. I just don't know if it is worth the trouble.

Ebay told me just to "take it" and move on. They said they understood my concerns, but it was no "big deal". To me, it is taking a white shirt to a job interview with a ketchup stain on it. No big deal??? So much for ebay and the feedback system, which is now broken.

I guess what really pisses me off is I was never paid, followed ebay procedures to the letter, and some ass can leave me bad feedback and lie about the whole thing, slander me and ebay supports him.

Ebay is right,just move on.
In the retail world,one never know what kind of customer he will encounter,ass or no ass,just move on,unless you have taken a fancy to 'ass' which is defined as

First, seek out an attorney.
Second, ask that he write a letter to eBay, and the buyer, demanding that the feedback be adjusted.
Third, bring an action against the person who harmed your business reputation.

Most likely, there will never be any court action. However, in settlement, feedback would be removed, your name would be cleared, and lawyers fees might be paid by the person who left harmful feedback.

Click on "Reply to Feedback received" in the right hand box.

Keep your response professional, something like "Unreasonable Buyer wanted item shipped before PayPal cleared his payment"

Of course the buyer gets to respond to that too and will probably still be a total ass but at least you stood up for yourself.

The buyer said she has been scammed on Ebay too many times.
She also said many sellers are happy to ship before payment is received.
She also said this seller sold the item to someone else before her,meaning he is dropshipping.
is that true?

LtRay - he already replied to the FB calling the buyer a lying ass.

Ass may not be profanity but I think he missed my point. My point was as you so well stated - remaining professional is the way to go.

Now the buyer has added more neg FB stating "Using buyer's money to order inventory/making profits by delaying shipments!"

I would contact ebay again and request they remove this as it is clearly slander. Don't stop to you talk to a supervisor and try to remain clam.

Not in Ebay dictionary!
Both buyer and seller have exchanged slanders and insults,call it quit and move on,if nothing else,getting a lawyer costs $$$$$$$$$$$$$$.
Most folks dont read feedbacks much,one neg is not going to hurt you !
Time is better spent finding more dropshippers !

PS, she sold a few things on Ebay, too awhile back and looks like she had problems as a seller, also.

How did you get her list of negs? I had the website until my hard drive crashed a few years ago.

The person who was doing the bidding and left the feedback was NOT HER. IT was her husband. Does he have any right to leave ANY feedback or bid under her name?

As far as slander, I have NOT slandered him. He lives in the same state I do. If he has a pile of negs, perhaps it is time someone showed him he is not immune to a lawsuit. I am retired, I have the time and the money. In fact, it is a case of he purchased with her account, left feedback under her account, and used his business to pay for the items, I got 3 different people to put in the lawsuit if this man had left a lot of bad feedbacks. I am sure they are as deserved as mine. And I stand by the fact that this guy is an ASS.

drjack: just click on her feedback score and it will bring up his / her feedback page, then click the tab that says FEEDBACK LEFT FOR OTHERS, or FEEDBACK AS A SELLER, etc. It is all there, you do not need another website.

PS: drjackk, if you look at the FB he/ she left, she / he called people THIEF!!, leaves neg and then says oops, sorry, etc. Doesn't seem to be a person I would want to deal with. I blocked that ID.

Thanks for the info. I see that this person IMO is a very nasty person. I also will have no problem proving that the information was lies he/she posted based on I was never paid by ebay for the item.

Also I noticed low number hits on my 4 secret categories. By chance, I stopped listing for a few weeks before and his/her was the only feedback on my 4 secret categories, and suddenly I have dropped from perfect in "item description". How can they say "item not as described" if they never recieved it? How can they complain about shipping time if it was never sent because I was never paid. You get my point.

This person likes to use the legal system, perhaps I DO need to teach him a very financially painful lesson.

I cannot believe this. Ebay has reversed themselves, and removed the bad feedback. No notes, no communications, they must have looked into it further and removed the bad feedback. What the hell, but I am happy. 100% positive feedback, and near perfect scores of the stars again.

I guess there is a god.
