Kobe Accuser Might Move Civil Suit to California

Move Would Be Made to Avoid Colorado's Limits on Financial Damages

DENVER (Nov. 8) -- Attorneys for the woman accusing NBA star Kobe Bryant of rape might switch her civil lawsuit from Colorado to California state court because of Colorado's strict limits on financial damages.
Lin Wood, one of the attorneys representing the 20-year-old woman, said Monday he and attorney John Clune are still doing research but they believe California does not limit civil-case damages.

"I am assured by lawyers I have spoken with in California that California law would provide our client with a significantly greater opportunity to be fully compensated for the injuries she suffered," Wood said. He and Clune expect to make a decision by the end of November.

The civil case accuses the Los Angeles Lakers star of raping the woman in his room at the Vail-area resort hotel where she worked in June 2003. A felony sexual assault charge against Bryant was dropped Sept. 1 after the woman decided she could not participate in a trial.

Wood said if the attorneys file a lawsuit in Orange County, Calif., where Bryant lives, they still could pursue the lawsuit filed in August in Denver federal court. Wood, however, said it was more likely they would drop the Colorado case because state law makes it difficult for a plaintiff to win more than $733,000 in damages.

One would think she could only file in the state the "offense" happened, as she is a resident of that state.

But then, I've never sued anyone (thought about it), so I'm pretty ignorant about this sort of thing.

If her lawyers think that going to Orange County is a good idea they all need to fired immediately. Conservative county, Laker country.... Not going to think positively upon someone who refuses to testify at the criminal trial because she just can't handle it but suddenly is more able when it comes to the money shot? Even less favorable when they know that she moved the suit for the sole reason of trying to get more money. OC may be big money but it's people who go to work everyday and earned that big money and they are not going to look favorably upon her.

According to what I have read she has lived in 5 different states since all that happened. There was an article on Yahoo yesterday that almost gave a day to day diary of what happened and how this trial fizzled out. It was quite interesting. I have seen a trial like this with a football star and an accuser and it wasn't a pretty trial. Football player was innocent and she was defamed along with the others that testified. Nobody wins in a suit like that.

Not in a case like this Nero - they get a percentage of the final settlement/award. Lawyers would be tripping all over themselves to get a percentage of this one. If she agreed to actual fees she truly is a complete idiot.

His lawyers are going to win out but in the end, I hink hers are going to lose huge... not only are the probably not going to get a big settlement, but this is not turning out to be a case that bodes well on the resume.
