Hi, I would like to tell everyone how Paypal handle my complaint and want ask for any advice.
I am both a seller and buyer at ebay for more than three years. Recently, I won an auction for an Sony
Vaio laptop (on October 16, 2001). Since this is the first time I purchase an expensive item, but the seller
only accepted money order, so after I won the auction, I asked the seller if he accepts Paypal and he
agreed. On October 18, 2001, I paid the seller by Paypal and he told me he will send out the laptop by
UPS and will email me with the tracking number after 5pm PDT. After that, I can't reach him for 36 hours.
I was kind of worry so I called my credit card company to cancel the payment. My credit card company
told me only Paypal can cancel the payment at that time, so I email Paypal and filed the complaint. I
was the first buyer to filed the complaint at ebay and Paypal. I then received an email from Paypal telling
me they have reversed my payment and they need 30 days to investigate in order to give me refund.
Meanwhile, I have talked to other buyers (it was a dutch auction) about the auction and some other
buyers also paid the seller by Paypal. On November 8, 2001, a Paypal representative Missy told me
Paypal is holding my money until the problem resolve. On the same day, one other buyer email me and
told me Paypal has already refund to him, he filed on October 25, 2001, one week after I did. I have email
Paypal almost everyday about the status of my case and they only told me they need 30 days to
investigate. I was so unset about Paypal, but, bad news. On November 18, 2001, a month after I filed the
complaint, Paypal email me the seller is at fault and I am due a refund, but since the seller's account has
$0, so I can't get back my money.
I want to know how Paypal handle my complaint. Three other buyers who filed at Paypal at least one
week later than I did have already received the refund, how come I can't have my money back? I email
Paypal about this, they only said they can't re-investigate the case and avoid answer my questions. I
was so upset and angry.
Is anyone who also have the same problem with Paypal? I have posted my case to my ebay page
(http://members.ebay.com/aboutme/maple125/), I will update it if I get any news from Paypal (I hope) or
others who are involved in this case.
Please advice.

you said this is a dutch auction of sony laptop,is the seller a crook just trying to take your money and run?
or he is waiting for your money so he can place an order with wholesale distributor ??
36 hours is not a long time,FTC allows seller 30 days,altho seller is expected to ship 2 days after cc is charged.
it may be possible since it is a dutch auction ,he is waiting for all payments to come in so he can place one order with the wholesaler,for discount or minimum order requirement.
or he could be using drop shipment and the drop shipper would not ship until he remit payment (aka your money) first .
or there could be delay due to availability,dont forget xmas is coming and many retailers are placing orders.
with mail being slow,xmas is coming,he could be running into snags ordering your laptops.
if he is inexperienced ,he does not know how to handle this but go into hiding and not answer your email?
so buyers run to paypal or cc issuer and complain,reversing charges and freezoing his account,so there is no way he can make good on the shipment as he has no $$ to buy these laptops.

also- if he is ordering from a wholesaler and a wholesaler carrying sony products is an established business ,it will require him to open an account with them or pay in advance.
he will need to request paypal to send him a check which spells days of delivery,then he sent to wholesaler which will take more days,so you will not be hearing from him in 36 hours.
do yourself a favor-before bidding on your favorite laptop or pc,find out if he does have the inventory on hand,is he a retailer with a store ??
a seller running a dutch auction of say 10 laptops -if he is a retailer,he may have them in his shop or warehouse,if he is working from his home,use your common sense-DO YOU REALLY THINK HE HAS 10 SONY LAPTOPS SITTING AROUND IN HIS LIVING ROOM READY TO SHIP???????????????????

To stopwhining,

I think you haven't read through my posting.

1. It is not a pre-order auction. The seller told me he has the laptops in stock.
2. The seller promised me he will ship out the laptop on the same day I paid him and he will email me with the tracking number after once the UPS man picked up the laptop from him before 5PM.

i did read your post.
anyone can say anything on ebay and promise you the moon.
it is up to you to check him out,ask yourself why are you buying from him and not bestbuy,compusa etc??
is it because it is cheaper,a lot cheaper,then ask yourself why is he willing to make less??
always ask yourself,why is it too good to be true??
i am selling a special cruise to the moon,5 meals a day and entertainment nitely for 14 days for 14.99,i want you to sign up NOW

Can you tell me how long I have to wait to get your respond (or Buyer Complaint Team's respond)? You told me they will email me last Friday. It is Wednesday already but still no email.

Hi Paypaldamon,

What is the outcome? Who contacted me? When? I never get any respond from Paypal. I want to know who filed the complaint first or if there is anyone who filed earlier than me and got the refund. Please don't just tell me I was contacted, NOBODY FROM PAYPAL CONTACT ME AFTER YOU FORWARDED MY CASE TO BUYER COMPLAINT TEAM.

Hi,

The information was sent yesterday. There was still no recovery to be made.

The other claims (the ones that were paid)you are referencing were against another account.

Are you saying Case #221771? As you can see in my ebay page (http://members.ebay.com/aboutme/maple125/), the buyer paid the same seller. Is the investigation for my case closed? I am not stupid, please don't try to fool me! If Paypal want to keep my money and don't want to refund to me, then I will keep posting my "auction" at ebay until I get my money back. Paypal knows I filed the complaint earlier than the one got the refund, don't fool me!

To Paypaldamon,

Are you/Paypal afraid to tell me I am the first buyer to file the complaint but I can't get any refund? Are you/Paypal afraid to tell others Paypal made a mistake in this case (so you/Paypal need to make a story saying the case I am talking about is against the other account)? The cases I am referencing in my posting is against the same account (Esteban Murguia - [email protected]).

Please post all the replies from the Buyer Complaint Team. You/Paypal never give me any answer that would satisfy me. Please do not give me any excuse again, coz if you fail to do it this time, people can tell the truth - Paypal is step on it's tail.

Are you ignoring my posting and afraid to answer my questions?

I want to hear what answer the Buyer Complaint Team gave you. Please post their email here.

Please explain why three other buyers who filed a complaint later than me have already got the refund (they paid the same seller like I did) but I can't get any money back. I have enough of this from Paypal already and I am not going to waste my time here. If I didn't see the answer here within 7 days, I will consider legal lawsuit against Paypal.

I can't believe Paypal said that the complaint I am referencing is against another account (Case ID: 221771), but we are paying the same seller.

Paypal just don't want to refund to me and want to charge an extra $900US "fee" from me. What a big joke!

PS: What is the meaning of "always free"? I have defrauded by both the seller (and Paypal), but Paypal still charged me fees for the transaction even I didn't receive anything from the seller. yeah,i read the article??i wonder how paypal got defrauded out of 5 millions dollars in such a short time,it must be a ring of crooks working together which should be easy to track down?you know find one and find them all ,kind of like al queda network?

You have done what PayPal requires, you filed the Buyer Complaint Form. Contact your credit card company and start a chargeback NOW.
Can you win? Yes- I won one a couple months ago. There is a few forms to fill out probably for your credit card company and it may take a month or so to resolve it,but it is worth it. Most credit cards dont even make you pay for the purchase while it is in dispute.
It is a good thing you used your credit card -you have some protection in instances like this.
I know youre mad. I was too when some sleaze seller took my money. But believe me, the rule about them recovering only what is in the sellers account applies to US buyers too. I went through the same thing.
If you want to quit taking PayPal , and you dislike (OK hate them right now) thats alright. The important thing for you to do right now is to use your chargeback rights with your credit card and get your refund.

Thanks for your advice. I have already filed a complaint to my credit card company and still waiting for their reply. Meanwhile, I am planning to suit Paypal as soon as my credit card company reply me.

I got ripped off by a guy using Paypal and I called my Visa card bank to do a charge back and the first several people I talked to said "we can't do that!". I then talked to several more people and the last one said "I will look into it". She told me that they have a new "Paypal policy starting this week". So a warning to all First USA Bank seems to pass the buck as much as the people at Paypal do. I hope you have better luck.

Hi Gurista,

Have you get your money back? I called my credit card company 2 days after I paid the seller by Paypal and they said they can't stop the payment, only Paypal can stop it (I then filed a complaint at Paypal but Paypal seems like want to let the seller withdraw his money before taking any action).

After Paypal told me the investigation is over and I can't get any money back, I called my credit card company again and they told me to send them all the emails from both seller and Paypal and they will do the work for me. It has been 2 weeks since they confirmed my complaint. I think they need a month to finish the case and if I have luck they will charge-back and gimme refund.
