PayPal says sued by FirstUSA for patent infringement
The lawsuit, filed last week in federal court in Wilmington, Delaware, alleges PayPal's service that lets individuals and businesses exchange money over the Internet, infringes two First USA patents for a "cardless payment system."

sounds like the judge needs to do more homework,judge should read her/his own contract with visa/mc,they all said arbitration.
i think with billpoint being phased out,paypal will revise its fee .

Possibly it will be the first step in breaking the arbitration clauses in all these contracts. If you've read what happens to some people, I'm sure you'd see how unfair it can be. I found this study and report. on the net. http://groups.yahoo.com/group/nopal-paypal/files/Abitrationreportfinal.doc
It shows that arbitration wasn't orginally used for these sort of cases.
