Hi, I would like to tell everyone how Paypal handle my complaint and want ask for any advice.
I am both a seller and buyer at ebay for more than three years. Recently, I won an auction for an Sony Vaio laptop (on October 16, 2001). Since this is the first time I purchase an expensive item, but the seller only accepted money order, so after I won the auction, I asked the seller if he accepts Paypal and he agreed. On October 18, 2001, I paid the seller by Paypal and he told me he will send out the laptop by UPS and will email me with the tracking number after 5pm PDT. After that, I can't reach him for 36 hours. I was kind of worry so I called my credit card company to cancel the payment. My credit card company told me only Paypal can cancel the payment at that time, so I email Paypal and filed the complaint. I was the first buyer to filed the complaint at ebay and Paypal. I then received an email from Paypal telling me they have reversed my payment and they need 30 days to investigate in order to give me refund. Meanwhile, I have talked to other buyers (it was a dutch auction) about the auction and some other buyers also paid the seller by Paypal. On November 8, 2001, a Paypal representative Missy told me Paypal is holding my money until the problem resolve. On the same day, one other buyer email me and told me Paypal has already refund to him, he filed on October 25, 2001, one week after I did. I have email Paypal almost everyday about the status of my case and they only told me they need 30 days to investigate. I was so unset about Paypal, but, bad news. On November 18, 2001, a month after I filed the complaint, Paypal email me the seller is at fault and I am due a refund, but since the seller's account has $0, so I can't get back my money.
I want to know how Paypal handle my complaint. Three other buyers who filed at Paypal at least one week later than I did have already received the refund, how come I can't have my money back? I email Paypal about this, they only said they can't re-investigate the case and avoid answer my questions. I was so upset and angry.
Is anyone who also have the same problem with Paypal? I have posted my case to my ebay page (http://members.ebay.com/aboutme/maple125/), I will update it if I get any news from Paypal (I hope) or others who are involved in this case.
Please advice.

Hi maple125,
Our Buyer Complaint Process does not guarantee recovery from a bad seller. It also operates on a "first-come, first-serve" basis...there could have been other claims ahead of yours, which would have meant the other parties were refunded what (if any) was in the account.

Hi paypaldamon,
My Paypal complaint case number is 216235. One of the buyers who got refund from Paypal has the case number of 221771. Two other buyers have filed their complaint later than me but they also got refund from Paypal. If it is base on "first come, first serve" basis, I think I deserve a refund.
I will forward all the emails from the seller, Paypal and the other buyers to you later.

While I feel for you and what happened, the post above really contains something that doesnt belong there. Namely , making an accusation that some ID that resembles paypaldamon's name is somehow him. It really is weakening your argument against PayPal rather than strengthening it.
I know you are mad. I know you dont like PayPal. Slinging mud and making accusations is just not going to get you results. The only thing that will right now is to wait for your chargeback to go through. It takes about a month or more to do that.
The articles are fine - they are educational. Spend time on the web and you can find tons more . Heck, there are even official groups you can join. Going to Ebay and looking for IDs that are Naru and resemble certain names must be time consuming and anyone can call themselves whatever they want there anyway - it doesnt prove a thing to find it.
Take a deep breath, and wait for your chargeback to go through.

Youre welcome maple125-
Now your post looks like someone who has a 'leg to stand on' as far as presenting an arguement about PayPal.
If your credit card functions like mine (Visa) you should see a 'hold' put on that transaction during the time your credit card company completes their investigation. That means you shouldnt have to pay for the transaction, or any interest associated with it.
When you send in your paperwork, make sure you include the email from PayPal stating that the seller was at fault but there was no $ in the sellers account. It will help your case.
Good luck- you should do fine with the chargeback.

I paid my credit card bill already. Will it be a problem for the chargeback? Where I can find the "hold" for the transaction? Is it in my credit card bill?
Do you think if I can still claim the insurance with ebay and Paypal? I paid $900US to the seller by Paypal, $550US by my credit card and $350US from my Paypal balance. I know if my credit card company do a chargeback I can only get back $550US and I still lost $350US. I am in Canada, do you think Paypal's insurance cover Canadian user?
I sent all the emails from both the seller and Paypal to my credit card company already.
