Recently I sold an item to someone on ebay who sent me the payment by paypal, waited until he received the item and then promptly claimed that he has never received the item to paypal and asked for a refund. I explained to paypal that I did send the item by 2day priority mail. The person who bought the item from me didnt acknowledge my email for a long time asking if he has received the item. In the meantime, after a few weeks, paypal on its own accord went ahead and reversed the transaction basically giving me the hose. Recently I received an email(I have proof!) from this person I sold the item to and he acknowledged that he received the item and couldnt reply back to my emails because he was out of town on family emergency and he would like to help me sort it out with paypal. I have sent numerous emails to paypal and not once have I received a reply. PAYPAL stole all the balance in my account and placed my account on "Restricted".
I want my money back and I want to close my account but Paypal wont even let me close my account since it is restricted.

What did this guy call himself? Did the guy send the money himself or did he have a "friend" do it?

Heres more information on my case..
It begins with the most recent email I received from Ozzie (the buyer) apologizing for the inconvinience.......and then as you go down you are going back in time..

I apoligize for any inconvienced but I just returned to town today. I was
out because a death in the family and I am just trying to catch up on my 560
emails I have. Well, I did receive the product. When I am not sure I left
right after all this started to happen. The post office left it with the
neighbor. Now if you can get me a contact number for paypal I would be
happy to call them and let them know what happened. As far as the negative
feedback there is nothing I can do. Or is there. I believe I gave you the
negative feedback because you never replied to my few emails and when I
tried calling you on the phone number you have on file with ebay or PayPal
the number was disconnected. So that is the reason for the negative
feedback. Now as far as the money. I need to verify that the money was
refunded to my account. As soon as I verify that the money is there I am
more than willing to send you back the money.

Well, I guess at this point we both have learned our lessons. When we get
an email lets reply to them ASAP that way no misunderstandings occur. But
believe me at this point it wasn't to my interest if the money had been
refunded or if the Item was received. My heart was with my immediate loved
ones and my loss of a family member.

Just a follow up email.. while I offer Ozzie my condolences for the loss of his family member..

THe issue here is paypal.. WIth their totally impotent customer service there is no way I can get this issue resolved. I had a balance in my account that Paypal has stole (after they reversed the transaction, apparently in response to Ozzie's complaint!) and now that Ozzie has acknowledged receipt of the item, there is no way I can get PAYPAL to return my money and lift the restriction

Did you use tracking or delivery confirmation? I also had this problem with PayPal but as soon as I could provide delivery confirmation, they gave me the money back. Without delivery confirmation you are out the money.

unfortunately I did not use tracking or delivery confirmation. All I have now, is this email from the buyer acknowledging that he has received the item, based on his latest email (see above) buyer seems to be in repentant mode and willing to help me out IF PAYPAL will listen.. Is there a number to call these goons at to get this issue resolved?

PayPal has a toll-free number ... 1-888-221-1161. It's not listed on their website and don't expect them to resolve anything. I spent an hour & 19 minutes on hold (and got tired of waiting and hung up) after they verified who I was.

Hi,

Based on the information below, I am going to assume that the buyer filed a chargeback with their credit card company (our Buyer Complaint Process requires filing within 30 days). The date of the transaction, as well as when you appeared to ship it, does seem to indicate that the transaction occurred in November.

In either circumstance, you would have needed to provide the information relative to the Seller Protection Program. You would have needed to have online tracking on the item that you shipped.

I am not in the office until tomorrow morning, but I will advise you as to what it was in the morning.

Hi,

This was a BUYER COMPLAINT filed in November (a partial refund was given to the user with this claim).

The buyer, if they have received the item, should have canceled the complaint.

I do have to stress the importance of following the Seller Protection Program (notably online tracking in your case).

HAVE YOU CONSIDERED CONTACTING THE BUYERS LOCAL POLICE DEPARTMENT REGARDING FILE A THEFT CHARGE AGINEST THE BUYER? IN TX WE HAVE A THEFT BY CK LAW FOR PEOPLE WHO BUY WITH A CK THAT IS NO GOOD. I KNOW THIS WAS A CHARGE BUT IT SEEMS THAT A SIMILAR LAW SHOULD BE AT WORK ON YOUR BEHALF. PERHAPS CONTACTING LOCAL LAW OFFICALS TO PRESS CHARGES AGINEST BUYER MAY BE THE INCENTIVE THE BUYER NEEDS TO GET YOUR MONEY BACK. ALSO CONTACT VISA OR MC. THEY PROTECT BUYERS BUT DO NOT CONDONE OR ASSIST IN A PURCHASE BY FRAUD. THEY WOULD POSSIBLY TAKE ANOTHER LOOK AT THEIR ACTIONS UP ON READING THE BUYERS LENGTHY EMAIL TO YOU STATING RECEIPT OF GOODS. IF THIS WAS BAISIS FOR THE REVERSAL I THINK YOU CAN GET THEM TO FIX PROBLEM.

There is a web site where you can READ about Paypal, get their addresses, phone numbers, etc., and a link to the Law Firm that is filing a Lawsuit against Paypal.

Paypal continues to steal money from me. I have supplied them with Delivery Confirmation, Signatures on Certified Mail Receipts, etc., and Paypal refuses to refund my money. They have seized my account since October of 2001.

Under Illinois Law, they are required to pay the amount of the purchase plus 3 times the amount in damages, and Paypal tells me when I call them on the phone, they are ONLY bound by California Law. California Law was amended in 1995 to offer the same damages for stopped payments as Illinois.

I have contacted the Police in the cities where the THEFT occurred, they have harassed me by email, which is a Felony here, as well as by phone, more felonies, and the local police will do nothing.

I have had the people who have bought the items, tell me they got them, and weren't satisfied, they ordered the wrong items, and they got what they ordered.

Paypal also refunded the same amount to the same person, who filed claims with 3 different email addresses, when they only paid me once, and I was never able to withdraw my money from the account.

Paypal expects me to SEND items out that people paid for, without me having the MONEY for the items!!

I have sent by Certified mail the Signatures of the items delivered, Paypal has refused to unlock my account and send me my money.

They have refunded money to Foreign Buyers, when the Buyer Protection does NOT apply to Foreign Buyers.....

Paypal tells me I violated their Terms of Use. Paypal HAS VIOLATED their terms of USE, it clearly states, that any and all actions that cause the account to be locked, will be turned over to an arbitration place and both sides can be presented.

Paypal after over 3 hours on the phone told me my account was locked, because I knew why, and after this three hours they told me I was selling child porn....

I sell automotive add on products.

Apparantly they seem to think TEXT is Child Porn. I am the Usenet FAQ Maintainer for the Traci Lords newsgroups, and a person who stole my Copyrighted FAQ and claims to be the author, seems to like to send emails to Paypal, etc., and claim I am a Child Porn Dealer. The FAQ web site had a Paypal Donation button on it, because the SERVER was going to start charging for FTP access.

My FAQ site lists all of Traci Lords Movies, there are NO photos, no graphics, etc., and the ONLY links on the page for buying her Movies on VHS and DVD are to places like CDNOW, Movies Unlimited, etc., that sell her movies. These are Mainsteam movies that are sold everywhere.

Child Porn as defined under the Law, is ANY graphical representation of and exploitation of a minor child in sexual situations, minor being anyone under the age of majority, 21.

How is TEXT porn? These same movies are listed in any Movie List for Traci Lords, IMDB, E!, etc..

I told Paypal I would remove the donate button from this site, but they continued to libel, slander and defame me....

My FAQ is an educational document, approved by usenet admin and stored on the FAQ-Server at MIT, and all it's mirror sites....

I find Paypal payments and shopping carts on Adult Sites selling Videos, etc., or MINORS under the age of 21. State laws have lower ages from 16 all the way down to 14, but under Federal Law, which takes precedence, they must be 21 or over. These places that accept Paypal state, you must be 21 or over to buy these videos.... Excuse me? The actors are 18 or over, but they can't even BUY their own PORN movies? Paypal is also used by File Sharing Authors to pay for their software. For those who don't know what file sharing is, it is the sharing of Copyrighted Material without permission of the Copyright Owners.

If you buy this File Sharing software from these Felon Copyright Infringers, and use Paypal, and then use them to do a search for items such as teen, etc., you get a list of all kinds of underage child porn that you can download, etc..

I'm going to assuem that you can also use Paypal to buy ILLEGAL drugs, etc., on the net....

I contend that Paypal is the main funding source for Osama Bin Laden and his terrorists. By the way, all the email you send to Paypal is directed to an outside source in New Delhi India.... Paypal is funding other countries, which probably channel that money into terrorist organizations....

If you want to help shut down Paypal, and get your money back, they are currently being investigated by four states regulatory commissions....
