I bid on a sweater "lot" and was outbid in the last minute. That was 3 weeks ago. The seller emailed me and offered me, the 2nd highest bidder, the lot. I would like to take her up on it, but I just checked her feedback, and shehas 36 positives, and 4 negatives. The feedback made me think.......am I protected but ebay in any way if she didnt send the clothes? I can't even leave feedback, can I? Any advice? Thanks in advance!

No, this would be an off ebay sale. No feedback, no nothing. This is not to say that all offers to the second highest bidders are scams.
Look at the sellers feedback, pro and con and then make up your own mind. Find out what the negs are for.

That's right you can't leave feedback. The seller also has a 9:1 ratio of negative which is pretty high. I wouldn't buy unless the ratio was closer to 100:1 or better yet 200:1. If you really want it that bad you might tell her to relist it with BIN and you will buy it through that auction. (maybe have her put it in the wrong category so only you will find it?)

As a practical matter, eBay offers no protection to you whether it's an eBay deal or not. The ability to leave feedback doesn't protect you. Their "insurance" is smoke and mirrors.
Make the decision based on your review of the seller's feedback and your communications with the seller. That is a pretty high neg ratio.
