I purchased the item, but it is never delivered. The problem is Paypal caqnnot do anything about it. Probably because the seller took out all the money.

In this case, do you think I should file a charge back with my credit card, since it was paid via Credit Card.

I dont know what's the consequence of this. Probably Paypal will close my Paypal account if I let my credit card company take care of this.

What do you think I should do?

I take it that you tried to contact the seller? If you did and did not get a response then I would file a complaint with paypal and only then would I contact my cc bank and ask for a chargeback.

Just follow p.p.guideline and you should be fine. Just how long was the timeframe from the close of auction to now?

he has already contacted paypal,it said seller has no money in his account so paypal cant do anything.
if you file chargeback with cc company,paypal would eat the loss and debit seller account.if seller ever accept money with that account,the proceeds will be netted against it.
as for you,you want to know if paypal would retrict your paypal account or not??
i think it depends on the amount,how much is it??

It has been 24 days already.

There items:
Two of them are from the same seller, which total $100-$110. That seller got NARU by eBay for having 11 negative feedbacks.

This one is $180.


Not sure if Paypal will term my account if I hand it to my credit card company. Probably I will not have a problem if I hand it to the cc company because I paid for the item but never received it.

I just worry that Paypal will get mad and term my account.

Do you use this account to receive money from auctions?

Oh heck, who cares. File with the credit card company. At the same time, use a different e-mail address and open a new PayPal account just in case they do restrict this one.

you can only have one paypal account,thats why they want you to confirm your address and verify your bank account.
if someday paypal finds out the two accounts are related,they will restrict the second account.
ebay has insurance which will give you some of that money ,i think the max is 200 with a deductible.three items will be 600 with 60 dollars deductible,you may get 540 back from ebay.
paypal may not restrict your account if you file chargeback with your cc company,have you asked them what they would do??

If you filed a complaint with Paypal and they sent you an email saying that they agreed with your complaint but he had no money in his acct, you have followed Paypal's rules and may then file a chargeback. They will not close your acct. If they do, you can contact Damon and he will re-open it.

somewhere i read that paypal will makeup the difference between what you paid and what ebay reimbursed you,does anyone recall ??

stormy is CORRECT -- what PP does NOT want is folks just filing chargebacks willy-nilly on a whim.

They DO require that you FIRST follow the BUYERS PROTECTION PROCEDURES before turning to your CC company for relief.

According to everything I've ever read on many boards, they will NOT restrict yer account if you FOLLOW THEIR RULES!

That only comes into play if you use Ebay's insurance. You MUST be denied a chargeback from your credit card or have not used a credit card. You can file an insurance claim with Ebay for up to $200 minus a $25 deductible as long as both buyer and seller were in good standing at the time of purchase (both had positive overall feedback). If Ebay approves your claim for up to $175 and you still have lost money, Paypal will give you up to another $200.

As an aside, I would change my email address on Paypal so that if they did close your account for doing the chargeback, you won't continue to get payments into the account. They are not supposed to close it but they did mine. Damon had to get it re-opened for me.
