QUESTION...WOULD YOU BUY UNDER THESE TOS?

..first, a couple posters commented on another thread about TOS turnoffs to some of us...everyone of us have the right to run our business as we see fit...if you not interested in reading this lengthy TOS, at least read the part i have set between the "*"...

-----------------------------c/pasted

IF YOU NEED TO CONTACT ME BEFORE, DURING OR AFTER THIS AUCTION. My new e-mail address is [email protected] Winner or negotiated buyer agrees to pay for shipping and insurance(not optional) priority only in U.S.A and any special box if necessary.. We do use UPS but not Fed Ex ground. We refuse to use Fed Ex . Foreign including Canada bidders welcome, and must get shipping cost after winning. I prefer money order but will accept U.S. check with at least a 7 to 10 day from time of deposit, before item is sent. I am away from home until the weekend so items are shipped Monday/Tues etc . I do not ship on approval therefore it is bidders responsibility to ask all the necessary questions relevant to this item before bidding. Everything is sold as is and all sales are final unless stated otherwise in listing. If exceptions are made to this shipping charges not refundable. If refund for item is agreed to item must be returned to us first before refund can be made. If we accidently do not list item description correctly we will only return bid price unless we got a question from bidder that we answered incorrectly but only if truly relevant (I.e. not if we miss some crazing) .We are not responsible for professional restorations we did not notice because it was so well.If we ship wrong item accidently you agree to send it back to us or to the correct bidder and that postage will be refunded after item is sent back to us or correct bidder and item is received. We are only home on the weekend so all questions where we must look at item must be done on weekend before auction closing or we cannot look at item. Insurance must be paid for by bidder and I am not responsible for shipping damage or loss but will help with claims for insurance. If payment is not received in 10 days after contact, I have the right to void transaction agreement. By bidding on this item you agree and accept with these terms even if you have not read it. I have had email breakdowns, so if you do not hear from me email me and keep trying, I will do the same. Thanks for bidding and good luck. and I'm the one that said I liked that other TOS!

First....I couldn't even read your TOS. It needs to be separted into sections. And don't keep repeating yourself...that makes it twice as long.

And now...duck! Because I'm sure some will slam you here. I liked the other TOS because if you had clicked on the link it was much more readable in their TOS than what you have written out here.

Run it through spell check also.

Heck-fire, I'd be backed out of that auction so fast it would make your head spin! I'm not gonna read that novel. If they can't at least put in a few paragraph breaks I'm not interested in what they're selling.

Second, if I DID plow through it, the part you've emphasized would convince me I don't want to do business with them.

Get this - if they send the wrong item the recipient is supposed to send it on to the right person, or back to them? If they mis-describe they will only refund bid price? They must be kidding!

And talk about fine print, that MS Sans Serif font size=1 is barely readable.

Amazing... they are getting some pretty high bids.

Here's my TOS, straight from one of my auctions: Please check my other auctions. I'm happy to combine shipping for you when possible.

That's it. There is some refund and smoke/pet stuff on my Me page but I doubt anyone ever reads it. I should probably change it.

Honestly speaking here -- I don't bid on auctions with long TOS's. Sorry. I can't be bothered with reading all of that stuff. When I go bid shopping, which is usually every day, I'm looking at pictures and descriptions. If the listing has a huge amount of writing in it, I don't even read it. There are millions of listings in ebay with multiples of "hard to find" items. I'll just find another listing that has the same thing for the same price without all the mumbo jumbo. Let's face it ... Ebay doesn't protect anyone and neither does paypal. If the seller accepts paypal credit card or debit card, I have recourse. If not, I'm SOL if there's a problem and if I choose to bid on their auction.

Just my 2 cents ...

glas: IT "AINT" MY TOS...
!!! i found the tos while searching. this tos IS in small font; black print on blue b/ground..hell, the only way i could read it was to h-lite making it reverse...
------
so, everybody "slam away." the owner is a six year veteran; so he/she probably paid their dues, more than once.
----------
i thought most would like to see how others run their business...right or wrong...
-------------------
and Lucy, u right...cant read it, have to plow thru it..i did only because , i was doing a search, and was curious about why say so little with so much effort - then i am guilty of doing that also...

myold - oops!

speaking of TOS, here's one from one of my bidders that sells and here's his on his ME page (which I do look at!)

This has got to be the worst looking TOS I've ever seen. I can't make heads or tails of it.

Hi all,

Well, his Me page IS kinda hard to read. Big fonts, many colors, poor grammar, etc.

But at least, unlike the TOS MyOldToy posted, this guy is fair if he goofs up.

"MisRepresented Items / Wrong items [ we are human & sometimes we make mistakes ]
Full Refund given including return shipping
.............{ yes we even reinburse your return shipping costs }..............
Call Imediately : as you have 3 DAYs from delivery to notify us , after 3 days : then its to Late SORRY"

This can't be real ... can it?

Line 3:We do use UPS but not Fed Ex ground. We refuse to use Fed Ex.

Later on down: We do use Fed Ex but not ups. We refuse to use UPS.

???

And

I am away from home until the weekend so items are shipped Monday/Tues

but

We are only home on the weekend so all questions where we must look at item must be done on weekend before auction closing or we cannot look at item

(rinse and repeat on that last one.)

So they're never home on the weekend but they're only home on the weekend, and they refuse to use UPS or FedEx but will entertain the notion of using FedEx or UPS?

And of course they graciously offer to "help you with an insurance claim." As if anyone but the original shipper could pursue a shipping claim ....

I need an asprin.

We do use UPS but not Fed Ex ground.

We do use Fed Ex but not ups. We refuse to use UPS

I know who this seller is. He is a well known loser to all of us.

He is still can't decide which side of an issue he should take.

~FROM THE "Truth is TRUTH / Lies are LIES" FILES ~

During a speech at the McCormick Tribune Foundation conference on terrorism on Feb. 26, 2001, this speaker asserted that the Bush adminstration was “paying no attention” to terrorism:

“What they will do is stagger along until there’s a major incident and then suddenly say, ’Oh my God, shouldn’t we be organized to deal with this?”
