I recentely purchased something from a seller named "parts_warehouse" I payed this seller within the first week and still have not rec'd my item, it has been over a month now. I've emailed him a bunch of times and called him as well. The seller kept promising to send my item but never did, then I called and told him to issue me a refund, I payed through paypal and the seller said he would have paypal do the refund, I told him I wanted HIM to send me a check due to the fact that paypal can take a long time to issue refunds as far as I know. He said he would send a check, of course I havent rec'd anything. What should my next step be?? Is there anything I can do to get my money back through paypal without it going through him?? ANYONE WHO CAN HELP ME PLEASE DO!!! I payed $115 and that aint no peanuts. Thank you, -yourelectronicstore

how did you pay him through paypal??
your own paypal fund,e check or credit card??
Paypal expects seller to shop within 7 days after payment received with online trackable dc to confirmed address for his protection.
your window for filing complaint with paypal is after 7 days and before 30 days .
If 30 days have past, paypal may do nothing.
In that case, you can either complain to ebay or file chareback with your cc issuer,if you paid him thru cc.
ebay insurance will reimburse you up to a certain amount with deductible.

The seller is BSing you. He can instantly refund your money through Paypal, just like sending any other payment. All he has to do is take a few steps, click on "refund payment" and send it. It would get to you right away. There is no delay unless it takes a day to debit his bank account. Paypal takes no action except to take the funds from him and return the funds to you.

Try emailing the seller again first and tell him that you will file a claim with Paypal for non-delivery if he does not refund within 48 hours.

If the seller does not refund, you need to take it up with Paypal directly. If it has been over 30 days since you paid through Paypal, they probably will not refund, per their user agreement. But DO try that first. They may take a few weeks to sort it out.

If Paypal will not refund, and you paid with a credit card, you can call your credit card company and in most cases, they will refund it. There may be a short delay while they investigate it. Paypal gets PO'd (from what I hear) if you do that, but the credit card companies do not want them to penalize you for using a servcie the credit card company provides and promotes.

In the future, if you use Paypal, always use a credit card as the form of payment. If the item does not arrive in two weeks, and was not a media mail item, begin emailing the seller. By 21 days after payment, with no delivery, demand that the seller refund by the 28th day after payment if the package still has not arrived.

At 30 days, dishonest sellers know Paypal usually won't obligate them to refund. Paypal actually requires sellers to deliver the goods in 7 days and requires they get delivery confirmation. Many sellers don't comply even if they are honest. But when you file a dispute, this is what Paypal asks the seller for as proof.

I recently went through this with a seller who I did believe sent my package, but I never received it. I was way overcharged for shipping. My fault for not asking what the "combined shipping" rate for auctions on 7 tiny items would be. I paid $9.00 to ship an envelope, but the seller did not buy insurance or get any tracking. The package was stolen or lost. Items plus shipping totalled around $42.00.

I kept telling her nicely after 10 days that the package had not arrived. She kept telling me to keep her posted and that it should arrive any day. After 25 days I nicely told her I wanted to save her the trouble of having to deal with a claim filed with Paypal, as in "you know how difficult they can be" and informed her I knew of the 30 day limit on claims. She was not happy about it, but quickly refunded on the 28th day, rather than face a dispute filed with Paypal. The refund instantly went through Paypal right back on my credit card as a refund.

In this case, the seller was honest, but made a mistake in not insuring the package, I had bought from her before with no problem. I maintained friendly relations throughout, although strained at times, and I will buy from her again.

Your seller may be selling items from a drop shipper, and may be honest. The drop shippers can take over 30 days in some cases to deliver. It has caused grief for a number of sellers. But you must act within 30 days on Paypal payments, no matter the situation.

Good luck,
Patty

Thank yall very much, I will see what I can do, the main reason I went with this seller was because he was supposedly a power seller, I dont think he should be able to carry that tag, his feedback is at 96%, i thought u had to have at least 98% to be a power seller...guess i was wrong. It has definitely been more than 30 days but i will still get in touch with paypal and see if there is anything I can do through them. I did an Echeck through paypal when i payed, I dont know if that helps any...I know I cant do a chargeback thats for sure, anyhow thanks again for the responses, especially yours Patty, that helped alot. -Marco

Marco,

You are welcome. I was once a newbie here and learned a lot of what I know now from the old hands here.
