I bid and won a Tiffany Ring on Auction.

The tiffany Ring arrived and it was not an original Tiffany Ring, I called Tiffany and ordered the same ring from them Just to double check my feelings.

Sure enough it was not original as the Seller stated in the auction. I contacted the seller and told them I was not happy and would like to return it since it is not original. The seller said "we get out items imported and sometimes a few will slide through the cracks" that was his answer to me.......but all his auctions stated ORIGINAL TIFFANY.......
He said I can return it so thats what I have done.
NOW, my question to you is, what if he don't credit my paypal account when he receives the ring, I sent it insured and signature comformation, and tracking.

I am asking this question because this Seller was taken off of Ebay, and is "not a registered user" any longer.

If he dose not credit my paypal account can I make a complaint with paypal?

I believe you are protected by P/P under the condition that this is fraud. Make a complaint to Safe Harbor & P/P about this. This is a black eye on all of us who sell on eBay.

If he is suspended from ebay,then you can pretty much count on him emptying his paypal account,his balance is zero.
How did you pay him??did you use a credit card??

there is nothing paypal can do for you except issue a stern warning to this 'seller'!!
if you paid with cc ,then you can file chargeback and paypal will eat the loss as i am sure this guy has no money in his paypal account.
or if you pay him thru check or money order,file mail fraud with USPS and wait ?
How much is involved??
There is also another way which i dont want to discuss here.

Go to the site map and get the details on Ebay's fraud insurance program. Be sure to pay close attention to the time limits. It can be tricky filing a claim. There is a $50.00 deductible, but at least you'll get a chunk of your money back.

The vast majority of Tiffany (read: Anything sold as brand new) are fakes. They are great if you want the look without the bizzar pricetag but if you are looking for authenticity, he only way to get it is to go directly to the source. Tiffany does not wholesale.

there is a company called Tiffany in Hong Kong,so when he said he imported most of his jewelry,he must mean the OTHER TIFFANY.
Hence the title -ORIGINAL TIFFANY.

Hi
To ans. a few questions,
I used my paypal account to pay for the ring.

I also agree that this was a bad move on my part since we are not talking about much money. I should have gone to Tiffany from the start like I always do.

The ring on ebay cost me 89.00 with shipping and the ring from Tiffany cost me $148.00 with shipping which when you compare the two rings you can tell right away the fake one.
But all the markings are the same, for someone that don't know the quality of Tiffany can be fooled and that is a shame because this Seller has lots of closed auctions with buyers.
Stopwhining..........what you mentioned is what I was concerned about, but honestly if I have to take the loss then I will have learned a lesson, never bid on impluse. Plus it cost me 8.00 to return so the total loss would me 97.00.
And when I think of how dumb it was for me to bid when the ring is not expensive to begin with. But I guess we all do things like this once in a while.........I hope I'm not alone here........lmao

i heard on the news weeks ago Tiffany is going sue Ebay as most of the Tiffany items on Ebay are fake.
has anyone heard that??

CHICAGO, June 21 (Reuters) - Luxury jeweler Tiffany & Co. has sued eBay Inc. , claiming the online auctioneer has contributed to violations of the Tiffany trademark by letting counterfeit items be sold on its Web site, a Tiffany spokesman said on Monday

A study of certain pieces of "Tiffany" jewelry sold on eBay this year showed that 73 percent of the jewelry was counterfeit, Mark Aaron, a Tiffany spokesman, said in a statement confirming the lawsuit, which was filed Friday afternoon in U.S. District Court in New York.

An eBay spokesman could not immediately be reached for comment.

The lawsuit asks that eBay be stopped from listing any "Tiffany" merchandise that is not genuine and for eBay to account for profits it made on the sale of counterfeit Tiffany merchandise or else pay up to $1 million for each type of fake Tiffany merchandise sold on the Web site, said James Swire, the lawyer representing Tiffany.

"We have been in correspondence with eBay for some period of time," Swire said. "A year ago, they declined to themselves police their auction sites for counterfeit Tiffany merchandise and said we should use the programs they have to police the site."

Using eBay computer programs, Tiffany had two employees work full-time policing the site and forced the shutdown of about 19,000 auction sites on eBay, he said. This year, Tiffany randomly bought silver "Tiffany" jewelry on eBay and found that 73 percent of it was counterfeit, 5 percent of it was genuine and the rest was promoted as "Tiffany-like" but not promoted as genuine.
